Terms of sale and hire

These terms apply when you buy, hire or have a machine serviced by Sweepers PTY LTD (ABN 51 144 050 751). Anything agreed in writing on your quote or hire agreement takes priority over these terms.

1. All orders

Quotes and prices

  • We price every sale, hire and service by written quote. A quote is valid for the period stated on it.
  • Prices are in Australian dollars and include GST unless the quote says otherwise.
  • Delivery, freight and any extras are shown on the quote. If something outside the quote is needed, we will ask you before going ahead.
  • An order is accepted when we confirm it in writing or deliver the machine.

Payment

Payment terms, including any deposit, are set out on your quote or invoice. If payment is overdue, we may hold further deliveries, hires or services until the account is paid, and you are responsible for reasonable costs we incur in recovering the debt.

Delivery

We deliver from our Cornubia workshop by our own vehicles or by freight carrier. Delivery dates are estimates; we will tell you as soon as we know of a delay. You need to give safe access to the delivery point and have someone there to receive the machine.

Finance

We don't lend money. We connect you with our finance partners, who specialise in commercial cleaning machine finance. Finance is provided by them under their own terms, and approval is at their discretion. See Finance.

2. Consumer guarantees and warranty

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or changes rights you have under the Australian Consumer Law.

  • New machines carry the manufacturer's warranty. The warranty period and what it covers are stated on your quote and in the manufacturer's documents. We handle warranty claims for machines we supplied.
  • Used machines are workshop-checked before sale. Any warranty offered on a used machine is stated on the quote.
  • Warranty does not cover normal wear parts (such as brushes, squeegee blades, filters and skirts), damage from misuse, accidents, incorrect charging, lack of maintenance, or repairs by others, unless the Australian Consumer Law requires otherwise.

To make a claim, contact us with the machine model, serial number and a description of the fault. We may ask to inspect the machine at your site or at our workshop.

3. Buying a machine

  • Training: operator training is included with new machines.
  • Risk: the machine is your responsibility from delivery, or from collection if you collect it.
  • Ownership: the machine stays ours until it is paid for in full. Until then you must keep it insured, in good condition and free of other claims. We may register our interest on the Personal Property Securities Register.
  • Returns: we do not accept change-of-mind returns unless we agree in writing. This does not affect your consumer guarantee rights.

4. Hiring a machine

The hire period, hire rate, freight, minimum term and any security deposit are set out in your hire quote or agreement. See Rental for the machines we hire.

Our responsibilities

  • Supply a clean machine in safe working order, checked before dispatch.
  • Give operator training at the start of the hire.
  • Fix or replace a machine that breaks down through normal use, as soon as we reasonably can.

Your responsibilities

  • Only let trained, competent people operate the machine, and follow the operating and safety instructions.
  • Use the machine only at the site address on the agreement, and don't move, lend or sub-hire it without our written consent.
  • Charge batteries, or refuel, as shown in training, and carry out the daily checks (such as emptying the hopper or tanks and cleaning filters).
  • Tell us straight away about any fault, damage, accident or theft, and stop using a faulty machine.
  • Keep the machine secure and insured while it is in your care.
  • Return the machine clean and in the same condition, apart from fair wear and tear.

Damage, loss and charges

You are responsible for loss of the machine, and for damage beyond fair wear and tear, while it is in your care. We will charge the reasonable cost of repair, cleaning or replacement, and explain the charge. Hire charges continue until the machine is returned or ready for collection. If you keep a machine past the agreed end date, we charge hire at the agreed rate for the extra time.

Ending a hire

Let us know when you are finished so we can arrange return or collection. We may end a hire early and collect the machine if it is being used unsafely or in breach of these terms, or if hire charges are unpaid.

5. Servicing and repairs

  • We service Fimap and RCM machines and other brands. See Servicing & parts.
  • We will give you a quote before carrying out repairs and won't go beyond it without your approval.
  • Replaced parts are disposed of unless you ask to keep them before the work starts.
  • Machines left with us are at your risk except where loss or damage is caused by us. Please collect your machine promptly once we tell you it is ready.
  • Our repairs come with the guarantees in section 2. Parts we fit may also carry a manufacturer's warranty.

6. Liability

To the extent the law allows, where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to meet a consumer guarantee is limited to, at our choice, repairing or replacing the goods, or supplying the services again, or paying the cost of doing so.

Subject to the Australian Consumer Law, we are not liable for indirect or consequential loss, such as lost production or profit, caused by a machine being unavailable or faulty.

7. General

  • We handle your personal information under our privacy policy.
  • These terms are governed by the laws of Queensland.
  • We may update these terms. The version on this page when you place an order or start a hire applies to it.
